LOT LINE ADJUSTMENT

Zircon Development – Tax Map #82.08-1-18/Toped Management – Tax Map #82.08-1-17 – Corner of NYS Route 12F and Salmon Run Mall Road – Lot Line Adjustment.

Jeremy Thompson, LaFave, White, & McGivern, on behalf of Zircon Development, submitted a completed application, SEQRA, lot descriptions, and proposed plans for a lot line adjustment for Zircon Development with Toped Management. Discussion followed.

Mr. Thompson will submit a revised copy of the lot descriptions as he discovered an error.

Motion 86-14: Motion by Mrs. Desormo, seconded by Mr. Smith to grant a lot line adjustment for Zircon Development with Toped Management for properties identified as Tax Map #82.08-1-18 and Tax Map #82.08-1-17. The lot line adjustment will consist of removing 1.45 acres from Tax Map #82.08-1-17 and adding it to Tax Map #82.08-1-18, as shown on plans prepared by LaFave, White & McGivern, dated 10/7/15, Sheet #1, File #2015Z-02, conditional upon satisfactory review of lot descriptions. A variance was granted for the setback from the former Bomax property to the property line of the previous existing property on August, 7, 2013 and it is the opinion of the Planning Board that the setback will carry forward for the entire parcel.

Ayes All: Motion Carried.

SITE PLAN

Mr. Rick’s Bakery – 17099 US Route 11 – Tax Map #90.20-1-16 – Construction of a 28′ x 40′ cold storage addition to the existing building.

The board reviewed proposed plans submitted by Mr. Rick’s Bakery, 17099 US Route 11, for the construction of a 28′ x 40′ cold storage addition to the existing building. Discussion followed.

A color rendered drawing needs to be submitted.

Motion 87-15: Motion by Mr. Boxberger, seconded by Mrs. Desormo to schedule a public hearing for the construction of a 28′ x 40′ cold storage addition to the existing building for Mr. Rick’s Bakery, 17099 US Route 11 for Monday, November 2, 2015 at 7:00 p.m.

Ayes All: Motion Carried.

SPECIAL USE PERMIT/SITE PLAN/LOT LINE ADJUSTMENT

Mary Mercer, 24097 NYS Route 12 – Tax Map #83.15-3-3 – Discussion for a special use permit/site plan/lot line adjustment.

Al Harris, on behalf of Mary Mercer, updated the board on the dilemma that Mary Mercer is facing regarding adding 5 apartments to her property at 24097 NYS Route 12. County and Town permits were issued and the work is completed, however, it has been discovered that zoning requirements do not allow the addition of these apartments and now they cannot use them. Mr. Harris stated that when the property was purchased, there were two apartments in the house and wanted to know if this could be considered as existing non conforming use.

Mr. Harris also stated that Mary Mercer is looking into purchasing adjacent property to combine with her property to meet the zoning requirements. Discussion followed.

The board decided that the will move forward with site plan and special use while they wait for a response from the Town Attorney to see if he agrees that this could be considered as existing non conforming use.

Motion 88-15: Motion by Mr. Boxberger, seconded by Mrs. Desormo to schedule a public hearing for special use/site plan for Mary Mercy, 24097 NYS Route 12, for Monday, November 2, 2015 at 7:00 p.m., conditional upon receipt of a completed application and result of the discussion with the Town Attorney.

Ayes All: Motion Carried.

The board also advised Mary Mercer to pursue the purchase of the adjacent property to meet zoning requirements in case the decision is that it cannot be considered as existing non conforming use.

Motion 89-15: Motion by Mr. Smith, seconded by Mr. Boxberger to adjourn the meeting at 9:15 a.m.
