Supervisor Bartlett opened the meeting with a roll call of the members present at 7:00 pm.

MOTION #62-2021

Supervisor Bartlett moved to adopt the minutes from the June 10, 2021 Regular Meeting, Councilman Prosser seconded.

The floor was opened for general comments:

Mike Crestani inquired of the Board of the status of his prior inquiry of extending public water to the remainder of County Rte. 60 (Floral Drive).

Supervisor Bartlett informed that the Board is not in a position to pursue the possibility at this time, as the town has too many projects going on at this time. They will revisit the topic in January 2022 to study the overall cost involved to the residents with the extension of the water district.

No one else wished to speak; the floor was closed.

Supervisor Bartlett accepted the Town Clerk’s Report.

MOTION #63-2021

WHEREAS it is necessary to enter into an Intermunicipal Agreement between the Town of Watertown and the South Jefferson School District for providing the summer youth program for town residents on an annual basis; and

WHEREAS, the agreement is for the calendar year 2021 which will expire under its terms and conditions on September 1, 2021;

THEREFORE, BE IT RESOLVED, the Supervisor is herby authorized to execute said agreement for the year expiring September 1, 2021.

A motion to adopt the forgoing resolution was offered by Supervisor Bartlett, seconded by Councilman Prosser.

MOTION #64-2021

WHEREAS, the Town Public Works Superintendent has certified to this Board that town public works employee Nicholas Hancock has successfully demonstrated that he is entitled to a wage grade increase from MEO-2 to MEO-1;

THEREFORE, BE IT RESOLVED, Nicholas Hancock is herby promoted to the wage grade position of MEO-1 with an increase in hourly wages to $24.12 per hour.

A motion to adopt the forgoing resolution was offered by Supervisor Bartlett, seconded by Councilman Desormo.

MOTION #65-2021

WHEREAS, the Town is in receipt of correspondence from the N.Y.S. Department of Corrections and Community Service. It outlines the terms and conditions of a transfer of responsibility of certain water main service infrastructure that previously serviced the Dry Hill Correctional Facility; and

WHEREAS, the terms and conditions outlined in the correspondence dated July 2, 2021 shall serve as a Memorandum of Understanding between the Department of Corrections and the Town of Watertown in the interim until a formal legal description can be provided by the Corrections Department; and

WHEREAS, the MOU provided by the Department of Corrections will ensure continued water service to the residents and property owners of the Boulder Ridge Housing Development which up to this point in time receives water service under a former agreement with the Department of Corrections and New York State; and

WHEREAS, a detailed list of physical assets is included and attached as “Exhibit A” for reference to assets being turned over to the control and responsibility of the Town Public Works Department.

NOW THEREFORE BE IT RESOLVED, the Supervisor is hereby authorized to execute the attached correspondence on behalf of the Town of Watertown Council who act as administrators of the Town of Watertown Water Districts; and hereby agrees to and accepted the position outlined within the agreement.

A motion to adopt the forgoing resolution was offered by Supervisor Bartlett, seconded by Councilman Prosser.

MOTION #66-2021

WHEREAS, the Town is in receipt of correspondence from the town’s assessor indicating his wish to retire in the near future; and

WHEREAS, following numerous interviews conducted by the assessor, the assessor has identified a replacement for his skilled position as being highly qualified to serve in the assessor’s absence; and

WHEREAS, the candidate for the assessor’s position is available for an interview at the Boards request, and a candidate interview should be conducted by the review committee composed of the Supervisor and Deputy Supervisor is hereby endorsed ay the Town Council for the purpose of recommending said replacement of the assessor.

A motion to adopt the forgoing resolution was offered by Supervisor Bartlett, seconded by Councilman Prosser.

MOTION #67-2021

WHEREAS, at a regular meeting of this Board held at the Town offices on the 8th day of April, 2021, an Order of this Board was duly adopted and entered in the minutes of the proceedings reciting in general terms the filing with the Town Clerk of the Town of Watertown of a map, plan and report prepared by Bernier, Carr & Associates, Engineers, Architects and Land Surveyors, P.C. (“BCA”) for the proposed extension of Sewer District No. 2 within the Town of Watertown, reciting the boundaries of the proposed District extension, the improvements proposed and the cost to construct such improvements and specifying that a public hearing shall be held to hear all persons interested in the proposed extension of Sewer District No. 2, TI Ag Park, at 7:00 p.m. on May 13, 2021; and

WHEREAS, a copy of the aforementioned Order of this Board was duly and regularly published in the official newspaper for the Town of Watertown and certified copies thereof were posted on the official sign board of the Town of Watertown as required by Article 12-A of the Town Law; and

WHEREAS, a public hearing was duly held pursuant to the aforesaid Order at the Town offices, 22867 County Route 67, Watertown, New York on May 13, 2021, at 7:00 p.m., and all persons interested in the proposed extension were provided an opportunity to be heard; and

WHEREAS, following the closing of the public hearing this Board voted unanimously to adopt a resolution making certain findings and determined to extend Sewer District No. 2 as presented by BCA, which resolution was subject to a permissive referendum; and

WHEREAS, within ten (10) days following the adoption of the aforesaid Resolution, the full text of the Resolution together with a notice setting forth the date of the adoption thereof and the fact that the resolution was adopted subject to a permissive referendum was published in the official newspaper of the Town of Watertown and posted as required by law; and

WHEREAS, more than thirty (30) days have elapsed since the adoption of the Resolution, and no petition protesting against the Resolution has been properly submitted to the Town Clerk of the Town of Watertown, and the Town Clerk has caused to be filed pursuant to Section 209-e(4)(a) of the Town Law a certificate certifying that no petition was filed requesting a referendum; and

WHEREAS, the permission of the State Comptroller is not required pursuant to Section 209-f of the Town Law.

NOW, THEREFORE, upon a motion duly made, and seconded, this Board hereby makes the following Order:

1. ORDERED that the aforesaid recitations are incorporated herein as if fully set forth hereafter, and it is further

2. ORDERED that the extension of Sewer District No. 2 as described in the map, plan and report prepared by BCA, the boundaries of which area described on Schedule “A” attached hereto and made a part hereof is finally established and the providing of the services thereof as described therein is hereby authorized, and it is further

3. ORDERED that the Town Clerk of the Town of Watertown shall cause a certified copy of this final Order of the Town Board to be duly recorded in the Office of the Clerk of the County of Jefferson, within ten (10) days after its adoption, and to file a certified copy thereof with the Department of Audit and Control within ten (10) days following its adoption.

MOTION #68-2021

WHEREAS, at a regular meeting of this Board held at the Town offices on the 8th day of April, 2021, an Order of this Board was duly adopted and entered in the minutes of the proceedings reciting in general terms the filing with the Town Clerk of the Town of Watertown of a map, plan and report prepared by Bernier, Carr & Associates, Engineers, Architects and Land Surveyors, P.C. (“BCA”) for the amendment to extension of Water District No. 1, TI Ag Park, within the Town of Watertown, reciting that the maximum amount proposed to be expended for the improvements to service the extended Town of Watertown Water District No. 1 shall be increased from $1,265,000 to $1,777,000 and that the number of EDUs proposed will be increased from 1,641 to 1,645 and specifying that a public hearing shall be held to hear all persons interested in the Amendment to the Extension of Water District No. 1, TI Ag Park, at 7:00 p.m. on May 13, 2021; and

WHEREAS, a copy of the aforementioned Order of this Board was duly and regularly published in the official newspaper for the Town of Watertown and certified copies thereof were posted on the official sign board of the Town of Watertown as required by Article 12-A of the Town Law; and

MOTION #69-2021

The following resolution was offered by Supervisor Bartlett, who moved its adoption, seconded by Councilmember Desormo, to wit:
BOND RESOLUTION DATED JULY 8, 2021

A RESOLUTION AUTHORIZING THE ISSUANCE OF SERIAL BONDS IN THE TOWN OF WATERTOWN IN AN AMOUNT NOT TO EXCEED $2,767,000 THE PROCEEDS OF WHICH ARE TO BE USED FOR THE DEVELOPMENT WITHIN SEWER DISTRICT NO. 2, AS EXTENDED, OF THE TI AG PARK PROJECT ALONG NYS ROUTE 3 AND THE INSTALLATION OF APPROXIMATELY 3000 LINEAR FEET OF GRAVITY COLLECTION MAIN, APPROXIMATELY 10000 LINEAR FEET OF SANITARY FORCE MAIN, AND A NEW SANITARY PUMP STATION TO TRANSPORT SEWAGE FROM THE DEVELOPMENT TO THE SEWER DISTRICT NO. 2 EXTENSION ALONG COUNTY ROUTE 202. GENERAL IMPROVEMENTS TO THE SEWER DISTRICT APPURTENANCES ASSOCIATED WITH THIS NEW CONNECTION.

BE IT RESOLVED, by the Town Board of the Town of Watertown, Jefferson County, New York, as follows:

Section 1. The aforementioned development within Sewer District No. 2, as extended, of the TI Ag Park Project along NYS Route 3 and the installation of approximately 3000 linear feet of gravity collection main, approximately 10000 linear feet of sanitary force main, and a new sanitary pump station to transport sewage from the development to the Sewer District No. 2 extension along County Route 202. General improvements to the Sewer District appurtenances associated with this new connection, (the “Project”) is in the interest of the citizens of the Town of Watertown. The estimated cost of such objects and purposes as determined by Bernier, Carr & Associates, Engineers, Architects and Land Surveyors, P.C., the engineers hired by the Town for such purposes are $2,767,000.00.

Section 2. It is hereby determined that the period of probable usefulness of such objects and purposes is forty (40) years; pursuant to subdivision (a)(4) of Section 11.00 of the Local Finance Law. It is further determined that no down payment is required pursuant to Section 107.00 of the Local Finance Law.

Section 3. The plan for the financing of such objects and purposes is by the issuance of grants through (NRBC), and/or grants through New York State Empire State Development (ESD) and/or the issuance of serial bonds not exceeding $2,767,000.00 of said Town hereby authorized to be issued therefore, pursuant to the Local Finance Law for a period in excess of five (5) years.

Section 4. The faith and credit of said Town of Watertown, Jefferson County New York are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall become due and

payable. Annual sewer rents shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year.

Section 5. Subject to the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes of the issuance and the sale of a statutory installment bond or serials bond herein authorized, including renewal of such notes, is hereby delegated to the Town Supervisor, the Chief Fiscal Officer. Such Notes shall be of such terms, form and contents and shall be sold in such a manner as may be prescribed by said Town Supervisor consistent with the provisions of the Local Finance Law.

Section 6. All other matters, except as provided herein relating to such bonds, including determining whether to issue such bonds having substantially level or declining annual debt service and all matters related thereto, prescribing whether to manual or facsimile signatures shall appear on said bonds, prescribing the method for the recording of ownership of said bonds, appointing the fiscal agent or agents for said bonds, providing for the printing and delivery of said bonds (and if said bond are to be executed in the name of the Town by the facsimile signature of its Town Supervisor), including the consolidation with other issues, shall be determined by the Town Supervisor. It is hereby determined that it is to the financial advantage of the Town not to impose and collect from registered owners of such bonds any charges for mailing, shipping and insuring bonds transferred or exchanged by the fiscal agent, and, accordingly, pursuant to paragraph c of Section 70.00 of the Local Finance Law, no such charges shall be so collected by the fiscal agent. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in addition to those required by Section 52.00 of the Local Finance Law, as the Town Supervisor shall determine.

Section 7. The validity of such bonds and bond anticipation notes may be contested only if:

(1) Such obligations are authorized for an object or purpose for which said
Town is not authorized to expend money, or

(2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit, or proceeding contesting such validity is commenced within twenty (20) days after the date of such publication, or

(3) Such obligations are authorized in violation of the provisions of the Constitution.

Section 8. Upon this resolution taking effect, a summary of the same be published in the Watertown Times, the official newspaper of said Town for such purpose, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law.

Section 9. This resolution is not subject to permissive referendum, pursuant to Section 35.00(a) of the Local Finance Law.

Section 10. This resolution shall constitute a statement of official intent for the purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein.

The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows:

The following resolution was offered by Supervisor Bartlett, who moved its adoption, seconded by Councilmember Prosser, to wit:
BOND RESOLUTION DATED JULY 8, 2021

The plan for the financing of such objects and purposes is by the issuance of grants through (NRBC), and/or grants through New York State Empire State Development (ESD) and/or the issuance of serial bonds not exceeding $1,777,000.00 of said Town hereby authorized to be issued therefore, pursuant to the Local Finance Law for a period in excess of five (5) years.

Section 4. The faith and credit of said Town of Watertown, Jefferson County New York are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall become due and payable. Annual Water rents shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year.

Section 5. Subject to the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes of the issuance and the sale of a statutory installment bond or serials bond herein authorized, including renewal of such notes, is hereby delegated to the Town Supervisor, the Chief Fiscal Officer. Such Notes shall be of such terms, form and contents and shall be sold in such a manner as may be prescribed by said Town Supervisor consistent with the provisions of the Local Finance Law.

Section 6. All other matters, except as provided herein relating to such bonds, including determining whether to issue such bonds having substantially level or declining annual debt service and all matters related thereto, prescribing whether to manual or facsimile signatures shall appear on said bonds, prescribing the method for the recording of ownership of said bonds, appointing the fiscal agent or agents for said bonds, providing for the printing and delivery of said bonds (and if said bond are to be executed in the name of the Town by the facsimile signature of its Town Supervisor), including the consolidation with other issues, shall be determined by the Town Supervisor. It is hereby determined that it is to the financial advantage of the Town not to impose and collect from registered owners of such bonds any charges for mailing, shipping and insuring bonds transferred or exchanged by the fiscal agent, and, accordingly, pursuant to paragraph c of Section 70.00 of the Local Finance Law, no such charges shall be so collected by the fiscal agent. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in addition to those required by Section 52.00 of the Local Finance Law, as the Town Supervisor shall determine.

Section 7. The validity of such bonds and bond anticipation notes may be contested only if:

(1) Town is not authorized to expend money, or

(2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit, or proceeding contesting such validity is commenced within twenty (20) days after the date of such publication, or

(3) Such obligations are authorized in violation of the provisions of the Constitution.

Section 8. Upon this resolution taking effect, a summary of the same be published in the Watertown Times, the official newspaper of said Town for such purpose, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law.

Section 9. This resolution is not subject to permissive referendum, pursuant to Section 35.00(a) of the Local Finance Law.

Section 10. This resolution shall constitute a statement of official intent for the purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein.

The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows:

MOTION #71-2021

WHEREAS, Grant funding is available through the U.S. Department of Defense Office of Local Defense Community Cooperation for communities undertaking development of projects that aid Fort Durm in the field of sustainability and enhancement of the health, welfare and moral of military troops and Fort Drum in general; and

WHEREAS, the 1000 Island Regional/Local Development Corporation requests that the Town of Watertown submit a grant application on their behalf for funding to assist with the construction of their 475,000 square foot Regional Athletic and Event Center complex; and

WHEREAS, the Sports and Event Center Complex will attract over 95,000 new visitors to the area annually and provide year-round International, State and Regional indoor sporting tournament activity, professional sporting clinics, physical fitness training, day care facilities, Class A indoor concerts, regional trade shows and large ticketed events, seasonal and year-round ice skating; and

WHEEREAS, the Fort Drum Garrison Command supports the project as the project will contribute to the enhancement of the health, moral and welfare of military troops and their families and increase tourism in the area;

THEREFORE, BE IT RESOLVED, the Town of Watertown Council supports the application on behalf of the 1000 Island L.D.C. for Grant funding from the D.O.D. Office of Local Defense Community Cooperation fund.

A motion to adopt the forgoing resolution was offered by Supervisor Bartlett, seconded by Councilman Prosser.

Old/New Business

Supervisor Bartlett applied for COVID Federal Relief Funds. The Town has been approved for $456,902.00 payable in two payments one in 2021 and the next in 2022. The funds are limited as to how they are to be used. He has a list of acceptable uses if the board members would like a copy.

Supervisor Barlett applied for intervenes funds from the Boralax solar panel project. These funds can be used to reimburse the town for codification and consultant/legal fees incurred with this project. He applied for $35,000.00.

Supervisor Bartlett informed the Board the income survey has been completed for the proposed NE Water District (NYS Rte 126 area) and will be ready for the Board soon. The median income came in at $38,000, this would allow for possible grant and low interest funding. GYMO should have the map, plan and report ready for next months meeting. It might be possible to lay drainage pipes at the same time they lay water lines in the Hampton Garden area to elevate the drainage problems.

Supervisor Bartlett updated the Board on the status of the event center.
