Members Absent:

Supervisor Bartlett opened the meeting with the Pledge of Allegiance followed by a roll call of members present at 6:00 pm. Attorney Russell was also present.

MOTION #1-2019

Supervisor Bartlett moved to adopt the minutes from the December 13, 2018 meeting, Councilman Prosser seconded.

MOTION #2-2019

Supervisor Bartlett moved to adopt the minutes from the December 27, 2018 special meeting, Councilman Prosser seconded.

Supervisor Bartlett opened the public hearing at 6:02 pm concerning proposed Local Law 1 of 2019. This is a Local Law to repeal Local Law 2 of 2018 a Local Law to override the tax levy limit established in General Municipal Law SS3-c. No one wished to speak; the public hearing was closed at 6:03 pm.

Supervisor Bartlett opened the public hearing at 6:03 pm concerning the proposed extension of Water & Sewer Districts #4 boundary lines as specified in the public notice. No one wished to speak; the public hearing was closed at 6:03 pm.

The floor was opened for public comments; no one wished to speak, the floor was closed.

Notice of the Association of Town’s Annual Training Conference

The Board discussed the benefit of membership to the Association of Town’s for the annual cost of $1,100. The Board agreed to not join the Association for the Year of 2019.

Supervisor Bartlett accepted the Town Clerk’s report.

MOTIONS/RESOLUTIONS

MOTION #3-2019

WHEREAS, it is necessary to establish an official newspaper for the publication of Town legal notices and announcements for the year 2019;

THEREFORE BE IT RESOLVED, the Watertown Daily Times is hereby designated as the official newspaper for the Town of Watertown for year 2019.

Supervisor Bartlett moved the foregoing resolution, seconded by Councilman McAtee.

MOTION #4-2019

WHEREAS, it is necessary to establish an annual schedule for all Town Council meetings to be held on a monthly bases for year 2019.

THEREFORE BE IT RESOLVED, that all regular monthly Town Council meetings will be held at 7:00 pm on the second Thursday of each month with the exception of the October will be conducted on the 1st (first) Thursday of the month and November meeting which shall be held on the first Thursday following the general election of 2019.

Supervisor Bartlett moved the foregoing resolution, seconded by Councilman McAtee.

MOTION #5-2019

WHEREAS, it is necessary to designate Legal and Bond Council for the Town of Watertown for year 2019;

THEREFORE BE IT RESOLVED, the law firm of Barclay, Damon, with offices at 120 Washington Street, Watertown NY is hereby designated Legal and Bond Council for the year 2019.

Supervisor Bartlett moved the foregoing resolution, seconded by Councilman Desormo.

MOTION #6-2019

WHEREAS, it is necessary to designate bank depositories for the safekeeping and investment of Town funds for the year 2019.

THEREFORE BE IT RESOLVED, Key Bank, M&T Bank, Community Bank, and Watertown Savings Bank are hereby designated as depositories and investment of town funds for the year 2019.

Supervisor Bartlett moved the foregoing resolution, seconded by Councilwoman McClusky.

MOTION #7-2019

WHEREAS, it is necessary to appoint an Engineering Firm to represent the Town on all matters requiring engineering services for the year 2019.

THEREFORE BE IT RESOLVED, the Engineering firm of Bernier Carr and Associates, 327 Mullin Street, Watertown N.Y. is hereby appointed Engineer for the Town of Watertown for the fiscal year 2019.

Supervisor Bartlett moved the foregoing resolution, seconded by Councilman Prosser.

MOTION #8-2019

WHEREAS, Assessor Roger Tibbetts has applied for the following splits and corrections to the 2019 tax roll for real property identified as:

Burnham Properties- 17747 US Rte 11, Lot 25M, tax map #90.16-1-14.21-122. Senior Citizens Exemption removed in error when owner switched to STAR check program removing Enhanced Star Exemption. Original bill was for $165.17, corrected bill is for $96.57.

Sunoco Retail, LLC- NYS Rte 12F, tax map #82.08-1-18.1. 485b Business Exemption placed on an incorrect parcel after split. Duplicates exemption already existing on parcel #82.08-1-18.2. Original bill was for $960.40, corrected bill is for $2,486.24.

Catherine Dawson, 21057 Weaver Road, tax map #83.11-1-43.22. Owner deceased no longer primary residence remove all exemptions. Original bill for $171.67, corrected bill is for $274.15.

MOTION #9-2019

Supervisor Bartlett offered a motion to accept the findings of the Short Environmental Assessment Form for the extension of Water 4-Sewer 4 on Co Rte 155, seconded by Councilman McAtee.

MOTION #10-2019
WHEREAS, the Town Board of the Town of Watertown in accordance with a map, plan and report has proposed a n extension of the Town of Watertown Sewer District #4 and Town of Watertown Water District #4; and
WHEREAS. Part I of a Short Environmental Assessment Form has been submitted to the Town Board relative to such extension of Sewer District #4 and Water District #4; and
WHEREAS, pursuant to 6 NYCRR part 617, this Board has reviewed Part II of the Short Environmental Assessment Form to determine whether the Action will have a significant effect on the environment; and
WHEREAS, pursuant to Article VIII of the Environmental Conservation Law and the regulations adopted pursuant thereto by the Department of Environmental Conservation, to wit: 6 NYCRR Part 617, this Board has determined that the Action will not have a significant effect on the environment, and will not cause a significant impact on the environment, and therefore, the preparation of an Environmental Impact Statement is not required.
NOW, THEREFORE, be it resolved by the Town Board of the Town of Watertown as follows:
1. Based upon the examination of the Short Environmental Assessment Form and the criteria set forth in 6 NYCRR Part 617, this Board makes the following findings.
A. The proposed Action constitutes an unlisted action pursuant to 6 NYCRR Part 617.
B. No potentially significant adverse impacts on the environment are noted on the Environmental Assessment Form and none are known to this Board.
C. There will be no substantial adverse change in existing air or water quality.
D. There will be no hazard to human health.
E. There will be no substantial change in the use or the intensity of use on the land.
F. There will not be created a material conflict with the community’s current plans or goals as official adopted.
G. None of the criteria listed in 6NYCRR section 617.11 will be present in the proposed Inspection and no similar criterial will be present which will adversely impact the environment.

2. The notice of Determination of Nonsignificance attached hereto is hereby accepted by this Board as its Negative Declaration in connection with this inspection.

3. The Town Clerk for the Town of Watertown is hereby directed to file in the Town in the file readily accessible to the public the Negative Declaration attached.

4. All subsequent notices concerning this inspection shall note that this Board has issued a negative declaration.
BE IT FURTHER RESOLVED, that this Resolution shall take effect immediately.

MOTION #11-2019

WHEREAS, by order of this Board dated December 13, 2018, a public hearing was scheduled for January 10, 2019, at 6:00 p.m., to consider the extension of Town of Watertown Water District #4 to include a parcel of land encompassing approximately 1.38 acres as more particularly described at Exhibit “A” attached hereto; and

WHEREAS, the order scheduling the public hearing was duly posted and published as required by law, and on January 10, 2019, at 6:00 p.m., a public hearing was held to consider all persons interested in the proposed extension of Water District #4.

NOW, on motion duly made and seconded, this Board makes the following determinations:

1. The Order scheduling public hearing was duly published and posted as required by law, and is otherwise sufficient.

2. All property and property owners to be benefited by the proposed water district extension are included within the boundaries of the proposed extension.

3. All of the property owners and all of the property located within the proposed district extension are benefited thereby.

4. The extension of Water District #4 pursuant to the map plan and report on file at the office of the Town Clerk, and upon which the public hearing was held on January 10, 2019 is in the public interest.

5. The extension of Town of Watertown Water District #4 as described in the map plan and report to encompass the property as described on the attached Exhibit “A”, is hereby approved.

6. This Resolution is adopted subject to a permissive referendum.

7. The Town Clerk is hereby directed to publish a copy of this Resolution in the official newspaper of the Town of Watertown within ten (10) days of its adoption.

MOTION #13-2019

WHEREAS, Local Law No. 1 of the year 2019, a local law to rescind Local Law No. 2 of the year 2018 which local law overrode the real property tax cap prescribed by Section 3-C of the New York General Municipal Law was introduced by a member of the Board at a meeting thereof held on December 13, 2018, and by a majority vote of the Councilmember’s present at such meeting, a public hearing was duly scheduled to consider Local Law No. 2 of 2018 for January 10, 2019 at 6:00 PM, and

WHEREAS, notice of the public hearing was duly published and posted as required by law, and on January 10, 2019, at 6:00 PM, a public hearing was duly held to hear all persons interested in the subject matter of Local Law No. 1 of 2019.

NOW, THEREFORE, be it resolved by the Board of the Town of Watertown as follows:

1. The foregoing recitations are incorporated herein and made a part hereof as if fully set forth hereafter.

2. The adoption of Local Law No. 1 of 2019 is a Type 2 action pursuant to the New York State Environmental Quality Review Act and the regulations promulgated thereunder.

3. Based upon the foregoing, Local Law No. 1 of the year 2019 is hereby adopted and the Clerk is instructed to file the same with the New York State Department of State.

Supervisor Bartlett moved to pay the following abstracts as audited.

Councilmember Prosser seconded the motion.

Supervisor Bartlett informed the Board that Ed Valentine owns property on the corner of NYS Rte 12F and Co Rte 202. He has inquired about the extension of water and sewer services to his property. The district currently runs adjacent to his property on the opposite side of Co Rte 202. Supervisor Bartlett informed Mr. Valentine he would need to prepare the plans and reports for the town attorney and engineer to review. It would be his responsibility to bare all the cost associated with the connection to the system. He would also need to get approval from the Jefferson County Highway Department to bore under the county road. After the town receives the required information a public hearing will be scheduled.

Mr. Russell updated the Board on the progress concerning the formation of the LDC. Supervisor Bartlett will be scheduling a meeting soon with all the parties involved in the convention project.

Supervisor Bartlett asked Mr. Russell to find out what the interest rates are for possibly bonding for a new dump truck for the highway department.

Councilman Prosser moved to adjourn the meeting at 6:35 pm, seconded by Councilman McAtee.
