March 5, 2014

Mr. Lanham called the regularly scheduled meeting of the Town of Watertown Zoning Board of Appeals to order at 7:00 p.m.

Motion 5-14: Motion by Mr. Cooney, seconded by Mr. Dulmage to accept the minutes of the February 13, 2014 meeting as written and distributed.

Ayes All: Motion Carried.

Public Hearings

COR Development – Beaver Meadow Apartments – NYS Route 3 – Variance request of 200′ road frontage & 20′ side setback requirements for financing purposes.

Legal notice was posted in the newspaper and evidence that adjacent property owners were notified.

The public hearing was opened at 7:02 p.m. No one from the public wished to speak. The public hearing was closed at 7:03 p.m.

Valentine Stores, Inc. (Nice N Easy) – Corner of NYS Route 12F & Salmon Run Mall Road – Four variance requests for proposed signage.

Legal notice was posted in the newspaper and evidence that adjacent property owners were notified.

The public hearing was opened at 7:03 p.m.

Mr. Lanham read the comments from the Jefferson County Department of Planning from a letter dated 1/3/14 (Attachment #1).

Mr. Lanham read a letter from Tom Boxberger dated 1/21/14 in opposition to these variance requests (Attachment #2).

Mr. Lanham read a letter from Pam Desormo in opposition to these variance requests
(Attachment #3).

Jim Smith, Planning Board member and resident of the Town of Watertown stated that he supported both Mr. Boxberger’s and Mrs. Desormo’s letters. He also noted that the City of Watertown has also adopted sign regulations similar to the Town of Watertown.

Mr. Lanham announced that the public hearing will remain open as the Valentine’s and their representatives were unable to attend tonight’s meeting.

Variance Requests

COR Development – Beaver Meadow Apartments – NYS Route 3 – Variance request of 200′ road frontage & 20′ side setback requirements for financing purposes.

Catherine Johnson, Legal Counsel for COR Development, presented proposed plans for variance requests of side setbacks for Lot #7 and road frontage for Lot #8 for Beaver Meadow Apartments, NYS Route 3 for financing purposes. Discussion followed.

Motion 6-14: Motion by Mr. Cooney, seconded by Mr. Dulmage to grant a variance for side setbacks for Beaver Meadow Apartments Lot #7 located in the Town of Watertown as shown on a map of Beaver Meadow Apartments, drawn by

Bergmann Associates, dated 1/29/14, conditional upon submission and satisfactory review of the Reciprocal Easement Agreement.
Ayes All: Motion Carried.

Motion 7-14: Motion by Mr. Porter, seconded by Mr. Dulmage to grant a variance for road frontage for Beaver Meadow Apartments Lot #8 as shown on a map of Beaver Meadow Apartments, drawn by Bergmann Associates, dated 1/29/14, conditional upon submission and satisfactory review of the Reciprocal Easement Agreement.

Ayes – 3
Nays – 1
Motion Carried.

Lauren Kent – 25246 Brookside Extension – Tax Map #91.11-1-13. Request for an area variance to turn existing garage into living quarters.

Lauren Kent presented proposed plans to turn an existing garage into living quarters. This parcel is zoned business and the use is allowed. An area variance is required as it does not meet the zoning requirement of a 3 acre lot for multi-family dwellings. Discussion followed.

Motion 8-14: Motion by Mr. Lanham, seconded by Mr. Porter to reschedule the regular April meeting of the Town of Watertown Zoning Board of Appeals for Wednesday, April 9, 2014 at 7:00 p.m.

Ayes All: Motion Carried.

Motion 9-14: Motion by Mr. Cooney, seconded by Mr. Dulmage to schedule a public hearing for an area variance for Lauren Kent, 25246 Brookside Extension for Wednesday, April 9, 2014 at 7:00 p.m.

Ayes All: Motion Carried.

No action will be taken on this matter as the Valentine’s and their representatives were unable to attend tonight’s meeting. The public hearing was opened and will remain open until the April 9, 2014 meeting.

Motion 10-14: Motion by Mr. Cooney, seconded by Mr. Lanham to adjourn the meeting at 7:45 p.m.
